NexHive operates as a South African online store and brand enablement platform offering selected technology, electronics, power, storage, networking, computing, bags, travel protection, fitness/performance technology, gaming and lifestyle products.

1.3 Definitions

1.5 Product information

We aim to display accurate product information, pricing, availability, images, specifications and descriptions.

However, product information may change without notice due to supplier updates, manufacturer changes, stock movement, marketplace updates, website errors or system delays.

Product images are for illustration purposes and may differ slightly from the actual product, packaging, colour, accessories or included components.

You are responsible for checking that a Product is suitable for your intended use before placing an order. Where a Product has technical specifications, compatibility requirements or installation requirements, please review those details carefully before purchasing.

1.6 Pricing

All prices displayed on the Website are in South African Rand unless stated otherwise.

Prices may include or exclude VAT depending on NexHive’s VAT registration status and the display settings on the Website. The checkout page and invoice will reflect the applicable price, taxes and delivery fees.

NexHive may correct pricing errors at any time. If a Product is listed at an incorrect price due to a system error, supplier feed error, typographical error, incorrect upload or supplier pricing error, NexHive may cancel the order and refund any amount already paid.

A Product placed in your cart is not reserved and the price is not guaranteed until your order has been accepted and payment has been confirmed.

1.7 Orders

An order is placed when you complete the online checkout process and submit payment details.

You will receive an order confirmation or checkout confirmation by email. This confirms that we have received your order request; it does not necessarily mean that the order has been accepted, dispatched or that supplier stock has been finally secured.

NexHive may accept, reject or cancel an order where:

  • payment is not received or is reversed;

  • stock is unavailable;

  • the Product has been incorrectly priced or described;

  • supplier information is inaccurate;

  • fraud or suspected fraud is detected;

  • delivery is not possible to the provided address;

  • the order breaches these Terms or applicable law;

  • NexHive is unable to fulfil the order for reasons outside its reasonable control.

If we cancel an order after payment has been received, we will refund you through the original payment method or another reasonable method agreed with you.

1.8 Payment

Payment must be made using the payment options available at checkout.

Payments may be processed by third-party payment gateways, banks or payment service providers. NexHive does not store your full card details on its own systems unless expressly stated and permitted by the relevant payment provider.

Your order may only be processed once payment has been confirmed.

Where payment is flagged for fraud review, verification or security checks, processing and delivery may be delayed.

1.9 Delivery

NexHive delivers within South Africa.

Standard delivery is R250 for orders under R2,000.

Orders of R2,000 or more qualify for free standard delivery within South Africa, unless otherwise stated on the product page, quotation or checkout.

Orders are usually dispatched within 1–3 working days after payment has been confirmed and stock availability has been checked.

Estimated courier delivery after dispatch is normally 2–5 working days, depending on the delivery address and courier service.

The total estimated delivery time is usually 3–8 working days.

Business days exclude Saturdays, Sundays and South African public holidays.

Delivery times are estimates only and may be affected by stock availability, supplier lead times, courier delays, public holidays, address accuracy, payment verification, remote-area delivery or events outside our control.

You must provide accurate delivery details. NexHive is not responsible for failed or delayed delivery caused by incorrect, incomplete or inaccessible delivery information.

Risk in the Product passes to you when the Product is delivered to the delivery address provided, collected by you or received by your authorised representative.

Ownership passes to you only once full payment has been received by NexHive.

1.10 Stock availability and supplier lead times

Some Products may be supplied directly from NexHive stock, supplier stock, distributor stock or fulfilment partners.

A Product shown on the Website may become unavailable after an order is placed. If this happens, we may offer you:

  • a refund;

  • an alternative Product;

  • a backorder option;

  • a revised delivery timeline.

You may reject an alternative Product or revised timeline and request a refund where applicable.

Supplier-sourced products, special orders and backorders may require additional processing time and may be subject to supplier availability.

1.11 Returns, cancellations and refunds

NexHive aims to handle returns and refunds fairly and in line with South African consumer protection law.

1.11.1 Change-of-mind returns for online purchases

For qualifying online purchases, you may cancel the transaction within 7 days after receiving the goods, without giving a reason, subject to applicable legal exclusions.

To qualify for a change-of-mind return, the Product should be:

  • unused;

  • complete;

  • in its original packaging where reasonably possible;

  • in a resaleable condition;

  • returned with all accessories, manuals, cables, components, protective materials, warranty cards and free items supplied with the Product.

For change-of-mind returns, the customer is responsible for the direct cost of returning the Product to NexHive, unless the Product is defective, damaged, incorrect or not as described.

1.11.2 Products that may not qualify for change-of-mind returns

Certain Products may not qualify for change-of-mind returns once opened, used, activated, installed or customised, where this is allowed by law.

This may include:

  • Products made to your specifications or specially ordered for you;

  • Products that are clearly personalised or customised;

  • sealed software, licence keys, digital products, activation codes or downloadable products once opened, revealed, activated or used;

  • Products with hygiene, health or safety concerns once opened or used;

  • consumables or Products that deteriorate, expire or are depleted through use;

  • Products that have been installed, modified, damaged, disassembled or permanently attached to other goods or property;

  • Products with missing accessories, missing serial numbers or damaged packaging where resale is affected;

  • clearance, demo or open-box Products where the condition was clearly disclosed and accepted before purchase.

This section does not remove your rights if the Product is defective, unsafe, damaged, incorrect or not as described.

1.11.3 Incorrect, damaged or defective products

If you receive the wrong Product, a damaged Product, an incomplete order or a Product that appears defective, you must notify NexHive as soon as reasonably possible using the contact details below.

We may request photographs, videos, diagnostic information, serial numbers, packaging images or supplier assessment before approving a return, replacement, repair or refund.

Where a Product is defective, unsafe or fails to meet the legally required standard, the available remedies may include repair, replacement or refund, depending on the circumstances and applicable law.

Where legally required, defective goods will be returned at NexHive’s or the supplier’s risk and expense.

1.11.4 Manufacturer warranties

Some Products may include a manufacturer, importer, distributor or supplier warranty.

Warranty terms may vary by brand, product category and supplier. Warranty claims may require proof of purchase, serial numbers, original packaging, diagnostic checks or return to an authorised service centre.

A manufacturer warranty does not remove any non-excludable consumer rights you may have under South African law.

1.11.5 Refund processing

Approved refunds will usually be processed through the original payment method where possible.

Refund timing may depend on the payment provider, bank, courier process, supplier assessment and whether the returned Product has been received and inspected.

Delivery fees may be refunded where required by law or where the return is due to an error by NexHive, a defective Product, incorrect Product or damaged delivery.

Where a refund is approved for a change-of-mind return, delivery fees and return courier fees may be deducted where permitted by law.

1.12 Promotions, discount codes and special offers

Promotions, discounts, coupons and special offers are subject to availability and may be withdrawn or changed at any time unless otherwise stated.

Promotional codes may be limited to specific Products, brands, categories, dates, stock quantities or customer groups.

NexHive may reject or cancel the use of a promotional code where it is used fraudulently, incorrectly or outside the stated promotion terms.

1.13 Business, marketplace and brand enablement services

NexHive may offer business services such as brand enablement, product sourcing, marketplace support, product listing optimisation, retail planning, eCommerce support, performance analytics, pricing support, channel strategy and related services.

Unless otherwise agreed in writing, these services are subject to a separate written proposal, quotation, service agreement or statement of work.

NexHive does not guarantee specific sales volumes, marketplace rankings, supplier approvals, retailer approvals, revenue outcomes or platform acceptance unless expressly agreed in writing.

Marketplace platforms, retailers, suppliers and third-party channels may apply their own rules, fees, compliance requirements and approval processes. NexHive is not responsible for decisions made by third-party platforms, retailers or suppliers.

1.14 Customer accounts

You may be able to create an account on the Website.

You are responsible for keeping your login details secure and for all activity under your account.

You must notify us immediately if you suspect unauthorised access to your account.

NexHive may suspend or close an account where we reasonably suspect misuse, fraud, unlawful activity or breach of these Terms.

1.15 Reviews, comments and user submissions

If the Website allows reviews, comments or submissions, you agree that your content must be lawful, honest, relevant and not defamatory, abusive, misleading or infringing.

NexHive may moderate, remove or refuse to publish user content where reasonably necessary.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under South African law.

Where liability cannot be fully excluded, NexHive’s liability will be limited to the amount paid by you for the relevant Product or Service that gave rise to the claim, where legally permitted.

1.22 Indemnity

You agree to indemnify NexHive, its owners, directors, employees, contractors, suppliers and partners against claims, losses, damages, liabilities, costs and expenses arising from your unlawful use of the Website, breach of these Terms, misuse of Products, infringement of third-party rights or submission of false information.

1.23 Force majeure

NexHive will not be liable for delay or failure to perform caused by events outside its reasonable control, including supplier failure, courier disruption, strikes, natural disasters, load shedding, internet failure, cyber incidents, government action, import delays, port delays, war, civil unrest, pandemics or other force majeure events.
